Ms Rinehart was due to face allegations in a NSW Supreme Court today that she engaged in serious misconduct over the lucrative trust, which was established by her father Lang Hancock in 1988 with her children as beneficiaries.

She has consistently denied the claims.

After a court adjournment today Christopher Withers, the lawyer for Ms Rinehart's children John Hancock and Bianca Rinehart, said they needed more time to work out who would take over as trustee.

Mr Withers told the court that Mr Forrest would file an affidavit tomorrow supporting John Hancock as the trustee.
