Victorian premier Daniel Andrews will reportedly be overseas when the controversial CFA workplace agreement returns to the Supreme Court.

Mr Andrews will be on a trade mission to China on September 22 when the trial begins, News Corp has reported, but the premier remains open to appearing if subpoenaed.

"If any court wanted me to appear I would be very happy to do that," he told ABC on Monday.
