WA surrogacy laws need overhaul: report

An independent review has found Western Australia's surrogacy and assisted reproductive technology laws are outdated.

Surrogacy and assisted reproductive technology laws in Western Australia are discriminatory and should be overhauled, a review has found.

A two-part report by independent reviewer Sonia Allan was tabled in parliament on Thursday following four public forums, seven parliamentary briefings, face-to-face briefings and 126 written submissions.

Among the 122 recommendations was amendments to discriminatory provisions that prevent access to assisted reproductive technology and surrogacy based on sex, relationship status, gender identity or sexual orientation.

The review also recommends a register so donor-conceived people can access information about their donor.

Health Minister Roger Cook said the government would give careful consideration to the recommendations.

"While there is an undeniable need to update WA's regulation around these practices, it is imperative that any changes we adopt are workable, serve the best interests of all involved and give precedence to the welfare of individuals born as a result of such practices," he said.
