Aslyum seekers who refuse to be deported would have a constitutional right to remain in Australia, if the High Court rules in favour of an Iranian man, known as ASF-17. The 37-year old says his ongoing detention is illegal, according to a precedent set by a High Court ruling last November. If successful, this landmark ruling would see Australia's migration system upturned for the second time in six months.
