Federal Government's Response to Religious Freedom

The government fails to directly commit to preventing religious schools from discriminating against LGBTI students and teachers.


The federal government has directly accepted 15 of the 20 recommendations of the Religious Freedom Review.

It has referred the remaining five to the Australian Law Reform Commission ((ALRC)) for consideration.

Questions about the right of private religious schools to discriminate against teachers and students based on their sexual orientation or gender identity have been referred to the commission.

The Association of Heads of Independent Schools of Australia has welcomed the government’s response.

The Law Council of Australia is concerned the government has not directly rule out allowing schools to discriminate against lesbian, gay and transgender students and teachers.

The Council's president-elect, Arthur Moses, says he doesn't understand why the matter is being referred to the Australian Law Reform Commission.
