Another asylum-seeker class action looms

Maurice Blackburn lawyers have filed another class action lawsuit on behalf of a four-year-old boy they say was detained on Christmas Island unlawfully.

Another class action by asylum seekers against the government may be in the offing with lawyers filing documents in the Federal Court relating to the detention of a four-year-old boy.

According to lawyers at Maurice Blackburn, who filed the documents on October 19, the boy was born in Darwin and then held for 480 days from September 2013 on Christmas Island with his asylum-seeker parents.

The boy was held for no specific reason and therefore unlawfully, the lawyers told The Age newspaper, and was granted a bridging visa within days once his matter was taken up by officials.

They said other asylum seekers were eligible to join the lawsuit on the basis the government did not look into their visa claims in a timely manner, detaining them for years for no specific reason.

They added the case, to be in court next in December, will explore untested ground.
