Photos released at the time showed him emerging from a small, pink suitcase that was being escorted by a Moroccan woman through the border crossing.
The woman's identity has not been made public.
The boy's family lived in Spain legally but they had reportedly been unable to get their son to live with them because they did not earn enough money.
The boy's father was later arrested and charged for attempting to smuggle him into Spain.
A government spokesman this week said the boy had been granted permission to stay in Spain for one year but his father will reportedly remain in custody will police investigate the case.
