Council sued over fatal tree branch fall

The mother of a four-year-old girl killed by a falling tree branch is suing the Victorian council responsible for maintaining the tree.

A mother who was injured by a falling tree branch that killed her four-year-old daughter is suing a Victorian council for not properly maintaining the tree.

Kristy Thomas and her daughter Patiya May Schreiber were struck when a branch fell in Bendigo's Rosalind Park on December 30, 2013, instantly killing Patiya and seriously injuring Ms Thomas.

Ms Thomas has filed a writ in the Victorian Supreme Court seeking damages including medical costs, claiming the City of Greater Bendigo was negligent in not adequately inspecting the tree,and not pruning or removing it.
