The fate of a three week old baby born to an asylum seeker in Brisbane could redefine the rights of stateless citizens in Australia.

It's a complicated case of overlapping legal jurisdictions, the United Nations convention of Stateless persons, and health issues affecting the mother and child.

Baby Ferouz and his Rohingya mother were at the centre of media attention recently when they were separated at birth by Australian authorities.

The Federal Circuit Court is now trying to work out if it can even hear the case on whether the government can remove the family to the Nauru detention centre.

Stefan Armbruster is in Brisbane and he's told Kristina Kukolja about what happened in court today.
