A NSW father who allegedly snatched his young sons from a northern NSW home is due to front court in the state's north.

A father accused of taking his two sons from their northern NSW home has been charged with breaching bail.

Daniel Brady, 38, was arrested on Monday morning after he was spotted walking along the main road at Suffolk Park, south of Byron Bay.

He was taken to Byron Bay police station and charged.

Police allege Brady snatched his sons, 14-year-old Jayden and Joseph, 11, from a Tweed Heads home earlier this month, breaching a court order.

One of the boys was seen at Tallow Beach in Byron Bay last week, sparking a search that led police to a camp where they believe the boys were staying with their father.

It was called off at dusk with police claiming the boys were actively avoiding search parties after one of the brothers was spotted fleeing.

Their father is due before Tweed Heads Local Court on Monday.

Police say they hold "serious concerns" for the brothers and have asked anyone with information to contact Crime Stoppers on 1300 333 000.
