The European Union's top court has ruled that tests to prove claims of homosexuality by asylum seekers are unlawful.

The European Union's top court has ruled that tests to prove claims of homosexuality by asylum seekers are unlawful.

Authorities must refuse all offers by applicants to demonstrate their homosexuality either through sexual acts or videos.

The ruling from the European Court of Justice made recommendations about not asking stereotypical questions about sexuality.

PhD candidate and Researcher at Sydney Law School, Senthorun Raj spoke to Hannah Sinclair about what the case might mean for Australia.
