Euthanasia campaigner Dr Philip Nitschke has won the right to appeal his suspension to practise medicine by the Medical Board of Australia.

Supreme Court Justice Graham Hiley on Monday handed down his judgment, setting aside the decision by the Medical Board of Australia to immediately suspend him from practising medicine anywhere in Australia after the suicide of Perth man Nigel Brayley.

Dr Nitschke's lawyer indicated they would apply for costs to be paid by the MBA, which will be resolved at a later date.
