Remy Gardner is set to take his place on the starting grid at the Australian MotoGP, but his father, motorcycling great Wayne Gardner, remains in custody in Japan.
Remy Gardner arrived back in Australia on Thursday after being detained with his father for their part in a minor car accident and an alleged road rage incident before Sunday's Japanese MotoGP at the Twin Ring Motegi circuit.
The younger Gardner rides in the second-tier Moto2 class for the Tasca Racing Scuderia team.
His place in Sunday's race at Phillip Island was put in jeopardy after the incident but his name appeared on an entry list released on Thursday evening, with Australian Grand Prix officials expecting him to start.
Remy was detained for three days as police investigated what he felt was a minor incident.
"For what it was, they're taking it very seriously, to be honest," Gardner told the Nine Network.
"Dad's issue is the main issue, but they wouldn't let me leave because I was a witness.
"In the end, they found out (who he is) and it looks like they're pushing harder ... it's a bit unfair.
"We're definitely in a pickle ... all of the circumstances that happened were just very unlucky."
Remy Gardner was released without charge, according to a statement released on Wednesday by his representatives.
Local police are believed to have charged Wayne Gardner for allegedly grabbing a passenger from the other vehicle involved by the collar during the traffic incident in Hiyama.
He is receiving Australian consular assistance.
