Implications of the Bob Day court decision

There are political ramifications for the Turnbull government from the High Court's decision on the eligibility of former Family First senator Bob Day.

WHAT FLOWS FROM BOB DAY CASE?

* A High Court judge will decide in coming days how the special count should be conducted. In the recent case of WA One Nation senator Rod Culleton being found ineligible, the vote preferences simply flowed to the next person on the party's ticket.

* The Australian Electoral Commission will conduct the special count and announce the winner.

* The winner of the special count will be sworn in on May 9.

* The number of senators will be restored to 76 for the first time in six months.

* The coalition (29 senators) will need 10 out of 12 crossbenchers to get its legislation through the Senate.

* If the special count winner is Family First's Lucy Gichuhi, the coalition will have another conservative ally on the crossbench.

* If Labor's Anne McEwen is declared the winner, the ALP's Senate numbers will rise to 27. The coalition would then need 10 out of 11 crossbenchers to pass legislation.

* If One Nation wins the seat it will have five senators - half of the votes the coalition will need to pass laws.

* In any case, the Australian Greens (nine senators) will no longer have enough votes outright to help the coalition pass laws. They will need to find another vote.
