Sexting Qld mum avoids jail again

A woman who sent graphic photos of her young daughter to a lover has had her suspended sentence extended after an appeal.

A Queensland woman who sent explicit photos of her young daughter to a lover has again avoided jail after an appeal of her sentence.

The woman was 41 when she was handed a three-year suspended sentence and probation last year for sending up to 19 photos of her 12-year-old daughter to a man with whom she was having an affair.

Earlier this month, former Queensland attorney-general Jarrod Bleijie appealed for a harsher sentence.

The Court of Appeal on Tuesday upheld the sentencing judge's decision not to send the woman to jail, but extended her suspended sentence from three years to five.

The sentence is only served if the woman reoffends.

The mother, a childcare worker who can't be named for legal reasons, has previously served a year behind bars for stealing $63,000 from a centre where she worked.

The judge who originally sentenced her decided it would be counter-productive to her rehabilitation to send her back to jail.

Court of Appeal Justice Catherine Holmes said in a written judgment on Tuesday it was open to the judge to have taken into account the woman's particular circumstances.

Fellow Court of Appeal Justices Anthe Philippides and Robert Gotterson agreed.
