The case against govt minister Gillespie

Court documents reveal the details of Labor's case against Turnbull government minister David Gillespie.

WHAT COURT DOCUMENTS REVEAL ABOUT THE CASE AGAINST DAVID GILLESPIE

* A writ of summons filed with the High Court on Friday claims the junior Turnbull government minister was "incapable" of being elected at the 2016 federal election and is incapable of continuing to hold his NSW seat of Lyne.

* It claims the Nationals MP should be penalised at least $200 for the time he has sat in the lower house since the July 2 election and another $200 for each day he continues to do so.

* It says Goldenboot, a company owned by Gillespie and his wife, Charlotte, in September 2015 leased premises for a five-year term on the basis it would "not be used for any purpose other than a retail post office".

* The leaseholder, Pamula Janett Humphreys, incurred an annual rent of almost $24,000 in the first year, increasing each year after.

* Australia Post then agreed to pay the tenant certain fees and commissions.

* Since Australia Post is a government agency, the tenant is receiving income from the commonwealth that can be used to pay rent to Gillespie's company, the documents say.

* Gillespie, through Goldenboot, had a direct or indirect pecuniary interest in the licensed post office agreement, the documents say.
