The Economic Regulation Authority will bring proceedings against West Australian power producer Synergy after finding it overcharged industrial customers for more than one year.
The ERA investigated prices offered by Synergy in the wholesale balancing market between March 2016 and July 2017, and found it achieved revenue between $40 million and $102 million higher than it would have had it bid according to the market rules.
The regulator said it would bring proceedings before the Electricity Review Board, which would determine whether Synergy breached the market rules and if so, possibly impose financial penalties.
A Synergy spokeswoman said the utility was reviewing the ERA's findings and would consider its options.
