Xie to stay another night in prison

Sydney man Robert Xie, accused of killing five members of his wife's family in 2009, will stay in prison another night amid delays on his bail release.

Accused Lin family killer Robert Xie will spend another night in prison following delays in his bid for bail.

Xie will add another night to his tally of four years, seven months and four days behind bars without conviction.

A Corrective Services spokesman told AAP that Xie was waiting for court papers to arrive, but since the court office closed at 5pm, he would stay imprisoned.

Xie's wife Kathy Lin told reporters waiting outside her North Epping house on Wednesday afternoon that his release was still some time off.

"Not today, not today," she said.

Earlier, Ms Lin said her husband was in good spirits but she didn't know if he would be able to leave Sydney's Silverwater prison on Wednesday.

"I need to go and do the paperwork," she told reporters camped outside the jail.

Xie is accused of killing five members of his wife's family in their northwest Sydney home in 2009.

In granting bail on Tuesday, Justice Fullerton imposed 17 strict conditions that she said would effectively put Xie under house arrest, including a requirement that he wear an electronic monitoring device.

The 51-year-old maintains his innocence and is expected to face a retrial in April after his marathon nine-month third trial ended last week in a hung jury.

His case returns to court for mention in February.
